Terms of Service

1. Agreement to Terms
By accessing or using Hours Cloud ("the Service"), operated by SystemsLab, LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
These terms apply to Hours Cloud, the managed service available at app.hoursapp.cloud. The self-hosted open-source version of Hours is governed by its MIT license.
2. Eligibility
You must be at least 18 years old to use the Service. By using Hours Cloud, you represent that you meet this requirement and have the authority to bind your organization to these terms.
3. Accounts
To use the Service, you must create an account with your name, company name, email address, and a password. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
You must notify us immediately at contact@systemslab.cloud if you become aware of any unauthorized use of your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorized access to any part of the Service or its systems
- Interfere with or disrupt the integrity or performance of the Service
- Upload or transmit viruses, malware, or other harmful code
- Use the Service to send unsolicited communications
- Resell, sublicense, or redistribute the Service without our written consent
5. Subscription and Payment
Hours Cloud is offered under the following plans:
- Cloud: $8 per user per month, billed monthly
- Non-Profit: $8 per month flat rate for up to 100 users, available to verified 501(c)(3) organizations or equivalent
Payments are processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
We reserve the right to change pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
6. Your Data
You retain all ownership rights to the data you submit to the Service, including time entries, projects, clients, and invoices ("Your Data"). We do not claim any intellectual property rights over Your Data.
You may export Your Data at any time. If you cancel your account, we will make Your Data available for export for 30 days following cancellation, after which it will be permanently deleted.
7. Intellectual Property
The Hours open-source codebase is licensed under the MIT license. The Hours Cloud service, including its infrastructure, branding, and proprietary features, remains the property of SystemsLab, LLC.
The Hours name, logo, and associated branding are trademarks of SystemsLab, LLC. You may not use our trademarks without prior written consent.
8. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for any downtime, whether planned or unplanned.
9. Termination
You may terminate your account at any time by contacting us at contact@systemslab.cloud.
We may suspend or terminate your access to the Service if you violate these terms, fail to pay fees when due, or if we reasonably believe your use poses a risk to the Service or other users. We will provide notice when possible.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, SystemsLab, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless SystemsLab, LLC and its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these terms.
13. Governing Law
These terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the state or federal courts located in Delaware.
14. Changes to These Terms
We may update these terms from time to time. We will notify you of material changes by posting the updated terms on this page and updating the effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised terms.
